Ole Horsfeldt started out as a general commercial lawyer, but over the past 20 years he has become what you would call an outsourcing lawyer as an attorney who specialises in companies” outsourcing or sourcing of business processes, IT services or integrated facility services. Today, Ole heads up our Outsourcing and IT Team of 13 lawyers. They are among the most highly specialised outsourcing advisers on a global scale. Our advice typically involves agreements with a regional or global reach and covers more than just “the agreement” or the legal terms. Our mission statement is to make outsourcing successful. In other words, we do not stop providing advice when the agreement has been concluded. Concluding an agreement is not difficult. What is difficult is being able to manage a complex outsourcing agreement and that is precisely the object of our advice on the legal, operational and strategic level. To Ole, client enablement is paramount – our advice must enable the client to manage and reap the expected benefits from outsourcing. Our agreement documents and concepts, such as proactive remedies, co-operation agreements, the “deliver first, settle later” principle and the fast track dispute resolution, have contributed to setting the standard for modern outsourcing in the Nordic countries. Many of these concepts are devised by Ole himself. In Ole’s work, the element of development – or to stay in the outsourcing and IT lingo, continuous improvement – plays an important role. A result of this is the development of a Contract Management method designed for managing long-term and complex sourcing agreements. The method includes six contract management processes, 16 contract management roles, detailed role descriptions and workflows, templates and much more. This goes way beyond the traditional framework within which “pure” legal advice is usually provided but it is decisive to making outsourcing successful.
