The National Economic Prosecutor, Jorge Grunberg (the “Prosecutorâ€), within the framework of the Competition Day that took place today, December 19, announced that during 2024 he will have his sights set on the labor market, to which the ―like any other market― fully the rules of free competition. He also emphasized the role that the National Economic Prosecutor’s Office has in investigating and supervising said market; especially in relation to possible anti-competitive effects on workers.
The Prosecutor highlighted three behaviors in said market:
Yo. Collusive agreements : he pointed out that agreements to fix wages, known as “ wage fixing â€; They are price fixing agreements (wages in this case); and that the agreements by which competing companies agree not to hire workers from other companies or “ no poaching agreements â€, are market sharing agreements. Both cases are anti-competitive and constitute a “hard cartelâ€, with respect to which market power is not required, nor is the conduct required to cause effects in the market to be sanctioned, in addition to criminal sanctions being applicable.
