Pursuant to the Foreign Investment Risk Review Modernization Act (“FIRRMAâ€), the Committee on Foreign Investment in the United States (“CFIUSâ€) now has authority to review non-controlling foreign investments in certain types of U.S. businesses that are involved with sensitive personal data of U.S. citizens, critical technology, or critical infrastructure. As part of this enhanced review process, CFIUS has paid particular attention to U.S. businesses operating, manufacturing, supplying, or servicing critical infrastructure in sectors such as telecommunications, utilities, energy, and transportation.
