The Council of Ministers in the meeting of 31 March 2022 approved the draft legislative decree for the implementation of the EU Directive 2019/1152 relating to transparent and predictable working conditions in the European Union.
The deadline for the transposition of the directive is 1 August 2022 .
The draft decree – which will amend the legislative decree of 26 May 1997, n. 152, which contains the provisions currently in force on the subject – it does not limit itself to transposing the contents of the directive on information obligations to the worker, but also establishes the “ minimum requirements relating to working conditions ” which will be the subject of a subsequent article .
The information obligations apply to the subordinate employment contract, including the agricultural one, for open-ended, fixed-term and part-time contracts; to the temporary and intermittent employment contract; to collaborative relationships with mainly personal and ongoing services organized pursuant to Article 2, par. 1, Legislative Decree n. 81/2015; to the coordinated and continuous collaboration contract pursuant to art. 409, paragraph 1, n. 3 cpc; to the occasional service contract as well as to other employment relationships (seafarers and domestic workers) (see art. 1 of the scheme).
