New Regulation of the Intellectual Property Registry

On July 11, Royal Decree 611/2023 was published, approving the new Regulation of the Intellectual Property Registry, which repeals the one approved by Royal Decree 281/2003.

In our current Intellectual Property system, the registration of works has a mere declarative nature, since, as indicated in the Consolidated Text of Intellectual Property (LPI), the author’s consideration is granted by the mere creation of the work. However, it must be taken into account that said law includes a presumption of authorship in favor of whoever is thus registered in the Registry, although proof to the contrary is admitted.

The regulatory development of the Intellectual Property Registry is imposed by the LPI itself, and the purpose of this last modification is to adjust the regulations of the Registry to the provisions of the laws of Common Administrative Procedure of Public Administrations (LPAC) and the Legal Regime of the Public Sector (LRJSP).
