Thick pancakes, thin patience?

For several days now, “serious” information has been circulating in Slovakia that Marian Kočner, who was legally convicted, had a problem with the amount of flour, i.e. the thickness of the pancakes served in the prison, which happened to be prepared by another, well-known to the public, who was legally convicted – Mikuláš ÄŒernák.

Does the prisoner have a legal right to thin pancakes, or an adequate thickness of the dish? Several lawyers of our office dealt with this topic, but similar to the current decision-making practice of the courts, they could not find a single legal opinion on this burning question.

How is it from a legal point of view

Pursuant to § 19 of Act no. 475/2005 Coll. on serving a prison sentence, the convict is provided with food three times a day, which:

  • corresponds to the recommended nutritional doses,
  • takes into account the type and difficulty of the work performed,
  • takes into account the age and state of health of the convict,
  • it also respects the cultural and religious traditions of the convicts.

Pursuant to § 30 par. 1 Decree of the Ministry of Justice of the Slovak Republic No. 368/2008 Coll., which promulgates the Regulations for the Execution of Imprisonment Sentences (hereinafter also referred to as the “ Regulation “), food is prepared according to approved menus, recipes for meals in shared meals, monetary limits for food preparation and the number of boarders within the scope of rations, usually in the prison kitchen. It is served according to the timetable in canteens, cells or rooms.

Pursuant to § 30 par. 2 of the Decree, food ration means the specified amount of food, which is provided to the convict on the basis of recommended nutritional rations according to age, state of health, assignment to work and peculiarities resulting from the requirements of cultural and religious traditions.
